Payment
Customers can pay by Paypal or cheque.
Cheques must be payable to A. W. Gallagher.
International customers can only pay by Paypal.
Delivery will only occur after full payment has been received and cleared.
If payment of deposit has not cleared within 10 days of the order being placed then the order will be cancelled.
Payment includes shipping, packing and delivery for UK customers only.
For customers outside the UK a shipping fee will be charged at cost in addition to payment for the item or items. Please email for an accurate shipping fee to your location.
Payments are only accepted in pounds sterling GBP.
Delivery
All paintings (unless otherwise stated) delivered are sent complete with their stretcher frames, ready to hang. They will be carefully packed and shipped, fully insured.
UK delivery is the responsibility of the seller and all UK delivery and insurance costs are met by the seller.
The artwork will be delivered to the address given by the buyer on the checkout form on the website or on the order form accompanying the cheque. Once delivered it will be the buyer's responsibility as owner of the artwork for any loss or damage.
Reproduction of the said artwork is prohibited without the express written consent of the artist.
A buyer must refuse to take delivery of artwork if damage is evident on arrival.
If a buyer refuses to take delivery of the artwork for any reason, other than evident damage, then expenses incurred by the seller for delivery and return of the item will be deducted from any refund.
Cancellations/Returns
The buyer may cancel any order within 7 working days. If an order is cancelled the buyer must notify the seller of their intention to cancel by email or in writing within the 7 day period. Please note that once the deposit is paid it is none refundable.
The buyer is responsible for return deliveries, including all delivery and insurance costs.
Buyers must return the artwork to the seller in perfect saleable condition.
Buyers must return the item/items in their original condition in order to obtain a refund.
Refund will only be made once the item/items have been checked and determined to be in their original and re-sellable conditionby the seller.
Damaged Goods/Insurance Claim
If there is any noticeable damage to the packaging on arrival the buyer must refuse to accept the item/items.
If the item/items appear undamaged and the buyer accepts delivery of the item/items before removing the packaging the buyer must sign the delivery documents accompanied by the word "unchecked".
If on unwrapping the item/items damage is discovered the buyer must notify the seller within 24 hours of receipt (or first thing Monday if a weekend delivery) of any damage to the item/items.
The buyer must send damaged items back to the seller using the seller approved courier. Details will be given on request.
The buyer must include the original packaging materials with the artwork when returning any damaged goods.
Refund will be subject to satisfying the seller's insurers that any claim is genuine.
Copyright
The copyright for all the artwork remains with the artist: the buyer is purchasing the original NOT the right to produce prints for publication. If publication rights are required the buyer should email the seller for prices and terms and the seller will make the required arrangements with the artist in question.
Miscellaneous
The seller reserves the right to amend the Terms and Conditions at any time.
These Terms and Conditions do not affect consumer statutory rights.
